Basically by US law it has to be at least 10% different to get away with how it looks
it might be bad for them if they blatantly ripped you off, you can try reporting it to see what happens if it's traced from your image
although i don't think she ripped off me only because i looked at the records and she had that character since 2002 as opposed to my character in 2005 or something D: but i didn't rip off of her either. i just found about her character a few days ago ;0;
and now i don't know whether to keep my character or not. or to tell the other person or something.
and again, i don't think i should report her, seeing that she had this character longer then i have. plus she couldn't have traced either because her art is just extremely better then mine >w<

there are lots of anime characters with pigtails and pink hair right? but no one's suing eachother over it (as far as i know)
i think you're ok, but i myself would go to this person and ask them if it was ok if i continued with my character and assured them they were original and they weren't ripped off by my work
if anything, maybe it means it's time to update your OC
